It's a long story... which I'll try to summarize highlight fashion, if you want more read the link.

The Xenu story appeared anonymously on alt.religion.scientology in 1994 in a series of postings called SCAMIZDAT.

The Scientologists said "it was a forgery".

I had made it known that I had a scanner and ocr software and folks started sending me copies off court records to scan and post the net.
At the bottom of the stack was a copy of what has become known as "THE FISHMAN AFFIDAVIT".

Due to my previous posting activity the Scientologists sent a couple goons to my home in November 1994. This ended up being an article in the Washington Post on Christmas Day 1994. see http://www.lermanet2.com/cos/lerma.html

Now, I looked at that copy of the FISHMAN Affidavit for 7 months, I saw it had as an exhibit, the "OT Levels" as I had seen them when I was a deluded member of this cult. The document was also in very bad shape, and required a weeks worth of hand typing information in that was not OCR-able.

After the Scientologists started posting that the Scamizdat versions of OTIII were "forgerys" and me, knowing they were the real thing, AND having a hard copy of the Fishman Affidavit... and having scanned in all the other affidavits folks had been mailing me... I scanned in the FISHMAN affidavit and posted it around the 1st of August 1995.

It was immediately webbed by Dave Touretzky at CMU and by Karin Spaink in NL. It ended up on over 200 websites at one point. A week later, after my posting, Scientology filed 6" of ex-parte filings in Federal Judge Brinkema's court - claiming that I was in possession of "Stolen property" - and Judge brinkema authorized a saturday morning raid on my home. Which made the Washington Post - http://www.lermanet2.com/cos/wpost.html and ABC news and CNN, and Wired Magazine's December 1995 issue 'alt.scientology.war'.

Scientology filed an amended complaint and sued the Washington Post for the 21 words included in the article they wrote. They later had to pay the Washington Post's attorney fees

Judge Brinkema later Vacated the raid - see Dave Touretzky's site http://www.cs.cmu.edu/~dst/Fishman/Lerma/index.html and pictures of the actual raid conducted by scientologists of my home at http://www.lermanet2.com/cos/raid.html -

and accused scientology of having unclean hands in open court for its conduct in this case for among other things not mentioning in 6" of ex-parte filings that what Mr Lerma had was no more than a legal copy of an usealed public court record from the central district of california.

It was an arduous court case. Scientology claimed to have spent 1,700,000 suing me over the FISHMAN AFFIDAVIT to earn them only a $2500 fine that I had to pay - and Scientology was awarded -0- attorney fees.

Scientology even tried to get Judge Brinkema Memorandum opinion SEALED in my case. Objecting to this passage: [ among others ]

" Scientologists believe that most human problems can be traced to lingering spirits of an extraterrestrial people massacred by their ruler, Xenu, over 75 million years ago. These spirits attach themselves by "clusters" to individuals in the contemporary world, causing spiritual harm and negatively influencing the lives of their hosts ". which ended up being used on a picketing truck used during picket's of their headquarters in Clearwater Florida.

Dave Touretzky's wbesite was the last US website to have it, CMU's a ttorneys put up a fight. Karin Spaink's pages in NL were the last pages outside of the US to have these documents - complete. I have heard rumors they are now on the freenet.
